Idaho GOP makes the common mistake in thinking marriage should be defined by the state under the 10th Amendment. They're close. Marriage is a 1st Amendment right, defined by the individuals entering into it and their community who recognizes it. The state's right to create legislation that provides protections, benefits and regulations to marriages within their borders is enumerated in the 10th Amendment. But the 14th Amendment's Equal Protections clause guarantees any state law is applied equally to the citizens.
It's a simple error in understanding our Constitution, yet is the cause of all of these court battles. Each ban will fall eventually because the Constitution will prove them illegal.
The GOP can be strong supporters of ALL marriage (which includes traditional marriage). We should focus on strengthening the family, not weakening it. This is why Republicans must support marriage equality.
